It’s only been a few days since actor Jussie Smollett was arrested for perpetrating a fake hate crime on himself but his defense strategy is already beginning to come into focus and it will seem familiar to many.
The star of Fox’s popular series “Empire” drew national media attention when he claimed that he was attacked on a frigid Chicago morning last month by two assailants in red MAGA hats who berated him with racist and homophobic slurs, poured bleach on him and left a rope around his neck.
Black presidential hopefuls including Democrat frontrunner Kamala Harris and Cory “Spartacus” Booker immediately exploited the incident as a “lynching” but while pols and the media rushed to judgment because they could weaponize Smollett’s story against President Trump and his supporters, the Chicago police found many inconsistencies in the story.
The big break came when the rope was traced to two Nigerian brothers who were taken into custody and spilled their guts that they were paid by the actor to stage the hate crime that was a hoax from the beginning.
Smollett was trapped like a rat and turned himself in to authorities. He posted bond and was out within hours and the public relations offensive by his legal team and sympathetic media figured quickly began.
By early indications, Smollett will rely on the tried and true defense of playing the victim and putting the focus upon the police on in what will be a racially-charged media spectacle unseen since the notorious O.J. Simpson trial.

Jussie Smollett’s legal team issued a defiant message Thursday accusing the Chicago police of organizing a “spectacle” and suggesting that politics has something to do with his legal conundrum.
Smollett has been indicted for disorderly conduct for allegedly filing a false report about a hate crime, and earlier in the day police said they believe the 36-year-old actor devised a hoax to further his career.
“Today we witnessed an organized law enforcement spectacle that has no place in the American legal system. The presumption of innocence, a bedrock in the search for justice, was trampled upon at the expense of Mr. Smollett and notably, on the eve of a Mayoral election,” Smollett’s legal team said in a statement. “Mr. Smollett is a young man of impeccable character and integrity who fiercely and solemnly maintains his innocence and feels betrayed by a system that apparently wants to skip due process and proceed directly to sentencing.”
It’s more than a bit hypocritical for Smollett’s legal eagles who are whining about the lack of due process in that the entire media and political left including congressional Democrats have thrown the bedrock legal concept out the window as they prosecute their vicious war on President Trump and any who support him.
Smollett himself was quick to participate in the lawless public lynching of Supreme Court Justice Brett Kavanaugh who was denied his own right to due process.

Smollett also plans to challenge the police over the evidence and according to a report, is claiming that the $3,500 check that he used to pay the brothers for their role in his hoax was for

Jussie Smollett has evidence that disputes allegations he paid two brothers $3,500 to help stage his hate attack, according to a new report.
A check showing that amount and made payable from the “Empire” star’s account to one of the men, Abimbola Osundairo, also has “5 week Nutrition/Workout program (Don’t Go)” written in the memo line, TMZ reported on Sunday.
Police and prosecutors said the check, dated Jan. 23, is evidence that the 36-year-old paid Osundairo and his brother Olabinjo to carry out the hoax assault in Chicago six days later.
But sources told TMZ that the payment was really for training to help Smollett get into shape for a music video for his song, “Don’t Go.”
It’s right out of O.J.’s own legal playbook.
Simpson’s high-powered legal “Dream Team” were able to successfully tar and feather the Los Angeles police as racists with a vendetta against the former NFL star who was accused of the brutal murder of his ex-wife and a male companion.
Despite a rock solid case against the former star running back, the shift of focus to the cops and specifically detective Mark Furhman appealed to the emotional makeup of a largely black jury and the Juice was loose.
Like LA, Chicago has been wracked with racial strife and there is still much anger over the 2014 police shooting of Laquan McDonald and although the cop who shot the young black man was found guilty of murder, it is a festering sore with the locals and many see the police as racist.
Smollett would benefit greatly from a trial that inflames tensions with law enforcement just like Simpson did and if the city gets burned down in the process that’s just collateral damage.
Johnny Cochran would be proud.
