The Texas Attorney General—allied with pro-gun groups—has asked a federal judge for a preliminary injunction to stop the ATF from imposing its new rules on stabilizing braces attached to large-format pistols.

Attorney General Ken Paxton, who is leading one of the numerous lawsuits against the looming brace rule, filed a 33-page motion in the U.S. District Court for the Southern District of Texas on Monday.
Allied with Gun Owners of America, Paxton argues the suit is likely to succeed on its merits, that the final rule unconstitutionally regulates handguns with attached braces, violates both the Second and Fifth Amendment protections of the Constitution, and that the ATF is exceeding its authority with the rule.
Paxton said:
I filed this lawsuit to ensure that pistol brace owners are protected from the anti-gun Left and the radical activists staffing Biden’s ATF.
As the case moves through our legal system, I am hopeful that the court will protect the Constitutional rights of Americans by issuing a preliminary injunction against this rule.
The law is on our side. We will prevail in this battle against the [Obiden Regime’s] war on the Second Amendment.
In addition to the challenge brought by Paxton and GOA, a second suit joined by 25 states led by West Virginia Attorney General Patrick Morrisey and North Dakota Attorney General Drew Wrigley, with the Firearms Regulatory Accountability Coalition along with gun industry members B&T USA and SB Tactical, is winding its way through a federal court in North Dakota.
Estimates of those impacted by the rule run as high as 40 million people.
Those found in violation could face up to 10 years in prison and a $250,000 fine.
