A California judge actually struck down a BS California gun control law. With that miracle, anything is now possible including an end to the BS coronavirus lockdown. Starting last year, California required anyone buying ammunition, not guns but ammo, to pass a background check and of course pay a fee. The judge, in his infinite wisdom, ruled this was unconstitutional and an undue burden on law-abiding gun owners. I checked, it’s not Opposite Day.
The AP reports:
A federal judge on Thursday blocked a California law requiring background checks for people buying ammunition, issuing a sharply worded rebuke of “onerous and convoluted” regulations that violate the constitutional right to bear arms.
U.S. District Judge Roger Benitez in San Diego ruled in favor of the California Rifle & Pistol Association, which asked him to stop the checks and related restrictions on ammo sales.
“The experiment has been tried. The casualties have been counted. California’s new ammunition background check law misfires and the Second Amendment rights of California citizens have been gravely injured,” wrote Judge Benitez in his decision.
Benitez called the ammunition background check law “onerous and convoluted” and “constitutionally defective.”
“Constitutionally defective” should be California’s state motto. Either that or “F*ck your rights.”
“Criminals, tyrants, and terrorists don’t do background checks. The background check experiment defies common sense while unduly and severely burdening the Second Amendment rights of every responsible, gun-owning citizen desiring to lawfully buy ammunition,” Judge Benitez wrote.
Criminals, tyrants, and terrorists are all protected classes of people in California so this ruling is likely to ruffle some liberal feathers in the Golden State.
Judge Benitez noted that the California law denied ammo purchases to law-abiding people 16% of the time. The judge also struck down a provision of the law that banned importing ammo from outside of California, citing interstate commerce rights. When California violates the Constitution, the go balls-deep.
Speaking of which:
Attorney General Xavier Becerra said in a court filing earlier this month that the background checks stopped more than 750 people from buying bullets illegally from July 2019 through January 2020, not including those who didn’t even try because they knew they weren’t eligible.
Oh yeah? Did Xavier arrest and prosecute 750 banned people for illegally trying to purchase ammunition? I already know that he didn’t because he’s completely full of shit. This law didn’t stop one criminal from getting their hands on ammunition, just hundreds of thousands of law-abiding Californians.
The reason why I know this for a fact is because criminals don’t follow the law; it’s what makes them criminals. Gun control laws don’t stop criminals from committing crimes, they just create criminals out of formerly law-abiding people. When liberals ban guns or magazines, this never stops scumbags from acquiring and using these things, but it does make people who have always been right with the law suddenly felons.
If a California judge can strike down a California gun control law, the world is wide open and everything we thought impossible is now a reality. Joe Biden could form a complete and coherent sentence. Democrats could actually represent the American citizens who voted them into office. CNN could broadcast a factual story. Nothing is out of reach now.
