Harvard law professor Alan Dershowitz joined Maria Bartiromo on Sunday Morning Futures to discuss Joe Biden’s upcoming Supreme Court pick. This from thegatewaypundit.com.
Joe Biden announced earlier this week that his selection to replace Justice Breyer will be a black woman. All others need not apply.
On Sunday Alan Dershowitz argued that this move by Biden is likely unconstitutional. He said:
I think it may be unconstitutional.
If he had said he was going to appoint the first… Muslim to the court, that would be unconstitutional. As the Constitution, Article 6, specifically provides that no religious test should ever be required.
I think the 14th and 19th Amendments also extend that to no racial or gender tests. Nobody should ever be excluded because they don’t fit a racial or gender criteria.
There are enormous numbers of qualified black judges who would make great appointees to the Supreme Court. And I would applaud if the president picked someone who also fit that criteria.
But to announce in advance, no whites, no males apply, brings us back to the when the Supreme Court was exclusively a white male institution.

Biden in 2022, being puppeted by Obama, et al, behind the curtain, is a far stretch from when Senator Biden filibustered for two Years the nomination of a black woman to Circuit Court. The following from westernjournal.com.

Although her nomination was preceded by a nearly two-year filibuster battle, centrists in the Senate finally brokered a deal to confirm Brown as the second black woman appointed to the nation’s second-highest court, as NBC News reported in 2005.
Yes, you read that right—Biden was part of an effort on the part of Senate democrats to use the filibuster to prevent Brown’s nomination—the same filibuster they now routinely inform us is racist.
Of course, in 2005, it was the ideal tool for Democrats, including Joe Biden, to prevent a black woman from being nominated to a circuit court because she was nominated by a conservative president and who, according to NBC, “supported limits on abortion rights and corporate liability and opposed affirmative action.”

And, despite mass propaganda media’s efforts to disregard the past, let’s remember that Biden was the senator who spearheaded an attempt to prevent now-Justice Clarence Thomas, still only the second black man to serve on the high court, from being confirmed in a now-notorious display of media-fueled political theatre.
Biden’s entire political history points to a commitment to playing politics, not ensuring appointments for black Americans in the federal court system.
[And here] his commitment to nominate a black woman to the Supreme Court rings of hollow virtue-signaling, and it’s shameful.
After all, he could have made history by electing the first black woman to the U.S. Supreme Court if he had simply nominated a black woman to the U.S. Supreme Court rather than first carrying on about how that was the criteria. Again, he’s being foolish and problematic, to say the least.
And now that the despicable Biden history is out on the table, how will the Republicans be reported by the mass propaganda media if they make any move to prevent the first black woman—obviously a woke liberal—from being appointed to the U.S. Supreme Court?
Exactly. Although the Biden history will not be given the legs it deserves, Republicans will be roasted on the fires of public opinion for any attempt to stop this “unconstitutional” appointment.
