Judge Napolitano to Newsmax: Jack Smith Didn’t Fool SCOTUS

Former New Jersey Superior Court Judge Andrew Napolitano told Newsmax on Tuesday that the Supreme Court was able to figure out U.S. Special Counsel Jack Smith’s true motive for wanting to bypass an appeals court on the question of Donald Trump’s immunity.

Napolitano told Carl Higbie on Frontline that Smith was trying to use SCOTUS to “further” his trial timeline, but it didn’t pass the smell test for the high court.

Judge Napolitano told Higbie:

For all of Jack’s Smith’s papers that he’s filed … the one thing they never mention is, why the rush? We all know why the rush.

They either want Donald Trump to be confined to a courtroom during the primary season in February and March or during the general election in September and October, or they want him to be convicted—they think they’re going to get a conviction—before the primaries are completed or before the general election, and they will never admit that.

Napolitano—a judicial analyst for Newsmax—was reacting to a Trump spokesperson earlier in the day saying that all of Jack Smith’s cases against Trump are designed to interfere with the 2024 general election.

However, the Supreme Court on Friday rebuffed Smith’s attempt to pull an end-around on the appeals process, declining to hear the appeal ahead of the U.S. Court of Appeals for the District of Columbia Circuit.

Napolitano further stated:

I think one of the reasons the Supreme Court shot them down is because they were not candid on that.

Because they were trying to use the Supreme Court of the United States to further their timeline and the Supreme Court, to its credit, without any decision whatsoever, just said, ‘We’re not going to hear it. Go back to the Appellate Court.’
