Convicted killer’s lawsuit claims religion entitles him to smoke pot in prison
CHARLESTON, S.C. – A South Carolina inmate has filed a federal lawsuit against the state prisons department, accusing the agency of violating his religious freedoms by not allowing him to smoke marijuana or keep his hair in dreadlocks.
In a suit filed last Monday, inmate James Rose accused the South Carolina Department of Corrections of violating his constitutional rights be refusing to give him marijuana “as part of the Rastafarian religious practice.”
Rose also said that the agency unlawfully required him to shave his dreadlocks, arguing that he should be allowed to grow his hair to “unlimited length” as part of his religion. According to the lawsuit, Rose said that prison officials held him down and shaved his head after he asked for pot in April 2017.
“The injuries I’ve sustained related to the events were migraine headaches, psychological trauma, mental anguish (depression), panic attacks, and nightmares,” Rose said in the handwritten lawsuit, which seeks $1 million in punitive and actual damages.
What a pussy! “They won’t let me smoke pot and shaved my head! PTSD!” You know what? Fuck you, Beldar. I bet the parents, friends, daughter, of the man you plotted to had killed are suffering a lot worse than that.
Rose, 41, is serving a life sentence following a 2013 murder conviction. According to authorities, he was involved in the execution-style murder of the son of a town council member in Lincolnville.
And just what was it that Beldar did to deserve all the “cruelty” he’s receiving in prison? According to the Post and Courier,
James R. Rose, 36, of Ladson, was charged in the shooting death of Leland M. Shannon Jr., 40, of Lincolnville.
Rose planned the execution-style killing and home invasion, according to prosecutors. He was not the triggerman, authorities said.”
Two other people, who wore masks during the incident and shot Shannon, are still on the loose and have never been identified by investigators, according to prosecutors.
Rose had known Shannon since he was 15 years old and planned the killing in response to a dispute over drugs, according to 9th Circuit Asst. Solicitor Jennifer Shealy, who prosecuted the case.
Rose had been buying drugs from Shannon, who had upped the price, according to authorities. Rose found that disrespectful and indicated to a friend in the days preceding the killings that he was becoming frustrated with Shannon, prosecutors said.
On the night of the murder, he indicated to another person that he was going to get his respect back, prosecutors said.
Rose enlisted two unidentified participants to invade the home on West Carolina Avenue in Lincolnville and shoot Shannon, prosecutors said. Shannon was shot four times; once in the head, once in the neck, and once in the shoulder by a handgun. He also was shot once in the leg by a shotgun, according to prosecutors.
Rose drove the car away from the scene, entered the home and shouted orders to the two men he’d enlisted to help him, prosecutors said.
The two triggermen put their guns to the head and chest of Shannon’s 20-year-old daughter during the incident, prosecutors said.
Nice guy, huh? And all this to “get his respect back,” yet this mighty wanna-be tough guy couldn’t even pull the trigger himself. No, pussy ass Beldar had to have others do it for him. The prisons agency doesn’t comment on ongoing litigation.
