‘GREAT NEWS’: Fifth Circuit Appeals Court REINSTATES Pro-Life Texas Fetal Heartbeat Law

Two days ago a federal judge blocked the pro-life law in Texas on the grounds that activist judges imagine the Constitution to be a living document and liberals seem to think they are better in touch with their feelings. But an actual court has now temporarily reinstated that law just days later. This from therightscoop.com.

The Obama-appointed judge called the Texas law an “offensive deprivation” of the “constitutional right” to an abortion, which is not a thing no matter how many times you say Roe v. Wade while looking in a mirror.

As Scoop pointed out in his article this week, Texas expected activist judges and was ready, immediately going to appeals.

Late on Friday, the Fifth Circuit set aside Pitman’s ruling and effectively reinstated the new law, at least temporarily, in a sparse, one-page ruling.

IT IS ORDERED that Appellant’s emergency motion to stay the preliminary injunction pending appeal is temporarily held in abeyance pending further order by this motions panel. Appellee is directed to respond to the emergency motion by 5 pm on Tuesday, October 12, 2021.

IT IS ORDERED that Appellant’s alternative motion for a temporary administrative stay pending the court’s consideration of the emergency motion is GRANTED.

This is amazing news, even for a short time, because it shows there are still avenues of genuine legal and constitutional recourse in this country, despite the best efforts of democrats—radical and moderate.

And any win over a left-wing activist judge is to be celebrated as a decision for conservatism. If the development becomes the striking down of Roe v. Wade, such an occasion will send many radical leftists into cardiac arrest.

Popcorn and drinks for everyone. Gloves and sanitary wet wipes will be unnecessary. This will be a hands-off affair. No assistance will be rendered.
